Acceptable Use Policy
This Acceptable Use Policy (“AUP“) sets forth the terms and conditions regarding acceptable use of the 6fusion Site and 6fusion Platform. Capitalized terms not defined herein shall have the meanings ascribed thereto in the 6fusion USA, Inc. End User Terms of Service located at http://6fusion.com/end-user-terms/ (the “Agreement”). All End Users are required to comply with this AUP and all applicable laws and regulations in full, in addition to all the terms and conditions of the Agreement, and any additional policies that may be applicable to a specific service offered by 6fusion. 6fusion strives to provide its End Users with the highest quality of service available, while at the same time respecting the standards that have been created both within the Internet community and by legislation, including but not limited to the statutes and policies of the Digital Millennium Copyright Act (DMCA) and CAN-SPAM. Inappropriate or abusive activities and conduct will not be tolerated on 6fusion.
The End User is responsible for complying with this AUP, and for providing prompt assistance to 6fusion in investigating and resolving any issue, as 6fusion may request from time to time. End Users are responsible for making reasonable attempts to immediately report to 6fusion any known or suspected issue that could compromise the stability, service, or security of any user or system connected to or associated with the 6fusion Site or the 6fusion Platform.
These lists are not meant to be exhaustive, but merely illustrative of examples of inappropriate and improper conduct, which are prohibited on the 6fusion Site and 6fusion Platform. The 6fusion Site and 6fusion Platform may only be used for lawful purposes. The transmission, distribution, or storage of any data or material in violation of any applicable law or regulation is prohibited. Upon discovery or notification of such violation, The End User will make reasonable efforts to document a mitigation plan for such violations within 48 hours. This includes, but is not limited to material or data which:
- Infringes any copyright, trademark, trade secret, or other intellectual property right.
- Violates export control laws or regulations.
- Violates any party’s confidentiality rights.
- Constitutes use or dissemination of child pornography.
- Is otherwise illegal or unlawful.
The following general actions are considered “abuse” and are strictly prohibited:
Any conduct inconsistent with generally accepted norms and expectations of the Internet community (whether or not detailed in this AUP). 6fusion reserves the right, in its sole discretion, to make a determination whether any particular conduct violates such norms and expectations. Using 6fusion to transmit material that 6fusion has reason to believe to be obscene or illegal. Forging of message headers or identity information, or taking any action with the intent of bypassing restrictions or limits on access to a specific service or site. This prohibition does not restrict the legitimate non-commercial use of pseudonymous or anonymous services. Falsifying identity or contact information (whether given to 6fusion or a 6fusion Reseller or Supplier).
End Users are prohibited from interfering or attempting to interfere with services (“Denial of Service Attacks”), whether intentionally or through neglect, of any other user, host, or network. The prevention of “unintentional attacks”, such as infection and subsequent propagation of computer viruses, are the responsibility of every End User: anti-virus software should be installed on every system that connects to 6fusion. End User is prohibited from circumventing, or attempt to circumvent security controls and processes in use on the 6fusion Platform. Any attempt to do so will result in account suspension.
6fusion APIs are provided for the legitimate and reasonable use of 6fusion End Users, partners, and others. By accessing an API, an End User agrees to be bound by this AUP and the 6fusion USA Inc, Terms of Service. Any use of the API outside those documented by 6fusion may be considered a breach of this agreement. Any excessive use of APIs, or use by users after account termination may also be considered violations of this AUP by 6fusion in their sole and exclusive judgment. End User agrees to cease use, or attempted use of the APIs upon request by 6fusion for any reason.
